TRACK-SPEED PARTICIPATION TERMS

General Terms and Conditions
- Scope of Application
These terms apply to all events organized by TRACKSPEED GmbH, located at Rudolf-Diesel Str. 4a, 53520. This includes track days with participants’ own vehicles, rental of TRACKSPEED vehicles, tourist rides, taxi rides, and events arranged by third parties. Tourist rides involve public use of Nürburgring tracks for a fee. TRACKSPEED events on race tracks allow participants to drive without speed limits under track rules. Co-pilot rides feature trained drivers. Road tours are guided rides on public roads, following traffic regulations.
- Event Purpose
The events are not intended for achieving high speeds or recording the shortest times.
- Participant Requirements
Only those with a valid driving license for the vehicle class used may participate. Participants must behave considerately. Events with personal vehicles are at the participant’s risk. Proof of statutory liability insurance and vehicle compliance with local traffic regulations is required where applicable. In events involving collisions, drivers are liable for their own vehicle damage. Consent from the vehicle owner is necessary if using someone else’s car. Vehicle admission is at the discretion of the organizer.
- Safety Regulations
Seat belts and safety helmets are mandatory. Participants must not endanger themselves, others, or the vehicles. Instructions from the organizer and track management must be followed. Non-compliance may result in exclusion from the event without a refund.
- Driver Briefing
Attending the driver briefing is mandatory for all participants.
- Passenger Regulations
Passengers must be at least 16 years old and participate at their own risk. Vehicles may carry a maximum of two people during track day events.
- Insurance and Liability
TRACKSPEED does not provide insurance for event risks; participants must arrange their own. TRACKSPEED is not liable for any damage, including when an instructor drives the vehicle. Vehicle owners are responsible for any damage to their vehicles.
- Track Rules
Participants must adhere to the current rules of the race track used during the event.
- Payment Methods
Accepted payment methods are cash, bank transfer in Euros, and major credit/debit cards. TRACKSPEED may require credit card authorization as security for other payment methods.
- Damage Costs
Participants must cover costs for track damage or tow services. Costs are paid immediately to the track operator or reimbursed to TRACKSPEED if advanced.
- Health Requirements
Participants must not have any health issues that could impair their participation.
- Event Modifications and Cancellations
Events will proceed regardless of weather. TRACKSPEED may modify or cancel events due to force majeure or extraordinary circumstances without liability. Force majeure includes events beyond control, such as natural disasters, pandemics, or governmental orders.
– a. If an event is canceled due to force majeure before it starts, a voucher valid for three years will be issued.
– b. If an event is interrupted, a voucher for remaining laps or unused kilometers will be issued, valid for three years.
- Participant Cancellations
Refund policies for cancellations:
– a. No refund for cancellations within 30 days of the event.
– b. 50% voucher for cancellations between 30-60 days before the event, valid for three years.
– c. 75% voucher for cancellations 60 days or more before the event, valid for three years.
- Agreement Submission
A signed copy of these terms must be submitted upon event registration.
- Recording Consent
If a dashcam is installed, participants consent to recording for safety and advertising purposes. Technical failure of recording devices does not entitle participants to a refund.
- Dispute Resolution
Any disputes will be resolved in the jurisdiction of the Koblenz District Court or another court at TRACKSPEED’s discretion.
Vouchers and Gift Certificates
- Purpose of Gift Vouchers
Gift vouchers can be purchased for specific services, packages, or set amounts, and may be intended for third parties as gifts or for use at an unspecified future date.
- Cancellation Policy
Orders for gift vouchers can be canceled within 14 days of purchase, subject to a processing fee of 10% of the voucher value (minimum €50). Cancellations after 14 days are not eligible for refunds, including cases of “change of mind” or “unwanted gift”.
- Right of Withdrawal
The 14-day withdrawal right is applicable only to gift vouchers. Vouchers issued for remaining kilometers/laps or for canceled packages or services are non-refundable under any circumstances.
- Transferability
Vouchers are non-transferable unless explicitly agreed upon with TRACKSPEED.
- Expiration
Vouchers are valid until the end of the calendar year, three years from the date of issue.
- Price Changes
If package prices have increased since the voucher’s issuance, the customer must pay the difference or can use the voucher value toward another TRACKSPEED package or service.
- Remaining Balance
Any remaining balance on vouchers will be retained as credit and cannot be refunded or exchanged for cash. Balances under €50 will expire.
Vehicle Rental Terms
- Vehicle Rental Overview
TRACKSPEED GmbH (TRACKSPEED) provides its own and third-party vehicles for rent during events such as track days, tourist rides, car control clinics, and tour rallies.
- Vehicle Condition
Vehicles are inspected and provided with a full tank, in operational, roadworthy, and clean condition. New tires or brakes are not guaranteed; vehicles are supplied as per the agreed rental package. Vehicles must be returned immediately after the rental period ends. TRACKSPEED will inspect returned vehicles and will charge €3 per liter for refueling if the tank is not full (applies to basic packages). Cleaning fees will be charged for excessively dirty interiors. TRACKSPEED is not liable for items left in the vehicles.
- Return Policy for Partial-Day Rentals
– a. For an 80 km (4 laps) package, return the vehicle within 2 hours of handover.
– b. For a 120 km (6 laps) package, return the vehicle within 3 hours of handover.
– c. All vehicles must be returned by 8:00 p.m. unless otherwise agreed. Late returns incur a fee of 15% of the booked service.
- Usage and Responsibility
Vehicles are to be used on designated tracks like Nürburgring Nordschleife, Nürburgring Grand Prix track, and other race tracks or public roads. Proper and foresighted use is required. Fuel and track fees are the renter’s responsibility. Renters must comply with all legal requirements and cover any fines or penalties related to vehicle use.
- Driver Restrictions
Vehicles may not be transferred to third parties. Only those named in the contract may drive. TRACKSPEED may substitute the vehicle at its discretion (due to weather, driver skill, availability, etc.), informing the renter immediately. Any price difference in favor of the renter will be compensated with a voucher valid for three years. No refunds will be provided for incurred costs.
- Vehicle Monitoring
Renters must monitor engine, oil, and water temperatures. Any defects or suspected malfunctions must be reported immediately to TRACKSPEED. Continued driving with a defect may cause significant damage. Costs for damage due to improper gear shifting (e.g., over-revving the engine) must be covered by the renter.
- Proper Use
Proper vehicle use is mandatory. Improper use (drifting, burn-outs, etc.) may result in warnings or prohibition of further use without a refund. Renters must compensate for damages or excessive wear caused by improper use. Standard wear is defined as one set of tires or brake pads per 1000 kilometers on the track.
- Mileage Packages
No refunds or credits for unused kilometers within the rental period, except if the event is cut short due to third-party fault or force majeure. In such cases, unused kilometers will be credited as a voucher valid for three years.
- Damage Liability
Renters are responsible for any damage to the rented vehicle, the track, other vehicles, or people, including towing and rescue costs, even if an instructor is present. This includes situations where the instructor assists or drives the vehicle.
- Security Deposit
TRACKSPEED may request a security deposit or in-car instruction at any time. The customer covers all related costs. Booking cancellations due to these requirements or non-payment will not be refunded.
- Payment Authorization
A credit card is required for payment authorization for all rentals, even if paying by cash, bank transfer, or debit card. TRACKSPEED reserves the right to authorize additional charges during the rental. Cancellations due to inability to present a credit card will not be refunded.
Cost Liability for Rental Car Use
- Renter Liability
The renter accepts full liability for any internal or external damage, theft, or mechanical issues (e.g., clutch) occurring during the rental period due to negligence or improper handling of the vehicle. This liability applies regardless of the reserved car and includes all repair costs or third-party estimates. The renter’s liability limits are as follows:
– Track day on any track or tourist rides on the Nürburgring Nordschleife:
– Hyundai i30N: €30,000
– Golf R mk8.: €55,000
– BMW M2: €60,000
– Cayman GT4: €100,000
– Porsche GT3 991.2: €150,000
– Cayman GT4 RS: €120,000
– Porsche GT3 992: €150,000
– Porsche GT3 RS 991.1: €130,000
– Public roads:
– All Porsche: €12,500
– All others: €5,000
Despite these limits, the renter’s liability for damages is restricted to the actual damage amount or the typical depreciation value. The renter may prove that damages were not due to negligence or improper use and that the depreciation is significantly lower. For intentional damages, the renter is fully liable (100%) regardless of the limits mentioned. Compensation payments do not transfer ownership of the vehicle or its parts to the renter.
- New Vehicle Depreciation
For vehicles less than 24 months old without significant prior damage (cosmetic or valued under €2,500), the renter will be charged for any depreciation in vehicle value.
- Third-Party Damage
The renter agrees to cover third-party claims up to €5,000 on public roads and up to €10,000 for track use (including tourist rides on the Nürburgring Nordschleife). For intentional damages, the renter is fully liable (100%) regardless of these limits.
- Security Deposits
A security deposit is required before the rental for the following vehicles:
– On any race track (including tourist rides):
– Porsche GT4 / GT4 RS: €10,000
– Porsche GT3 991.2 / GT3 992 / GT3 RS 991.1: €15,000
– On public roads:
– All Porsche: €5,000
– All others: €2,500
TRACKSPEED reserves the right to request deposits for other vehicle types at its discretion (e.g., due to weather conditions, driver age, or driving behavior).
Participation in Co-Pilot Rides
- Service Offering
TRACKSPEED GmbH (the organizer) provides co-pilot ride experiences (racing taxi rides) at various events.
- Event Purpose
These events are not designed to achieve maximum speeds.
- Vehicle and Driver Standards
The organizer ensures that all vehicles used are race track-suitable and in excellent technical condition. Only qualified and experienced drivers conduct the co-pilot rides.
- Participant Responsibilities
Participants must be aware of and agree to adhere to all general participation conditions, including those set by the organizer and the race track operator.
- Driver Authority
The driver has full discretion over the co-pilot ride. Participants cannot request specific driving styles and must not interfere with the vehicle’s operation. Participants must follow all instructions from the organizer and the driver.
- Liability Exclusion
The organizer and its agents are not liable for any personal injuries or property damage incurred by participants during the event, except in cases of intent or gross negligence.
- Health Guarantee
Participants must confirm they do not have heart or spinal problems, or any other conditions that could impact their participation.
- Third-Party Services
The organizer may outsource the service to a carefully selected third party, ensuring the same type and quality of service. In such cases, the organizer is only responsible for the careful selection of the third party, not for the execution of the service itself.
Placement of Racing Teams
- Service Overview
TRACKSPEED GmbH (TRACKSPEED) facilitates connections between interested parties and ride-sharing providers at racing events.
- Service Scope
TRACKSPEED’s role is limited to selecting the provider and facilitating the services for the participant. No additional services are provided by TRACKSPEED.
- Contractual Agreement
The service contract is directly between the provider and the participant, with TRACKSPEED not being a party to or responsible for the contract or its execution.
- Fees and Payments
Services offered by the provider include a brokerage and processing fee for TRACKSPEED. Payments for these services must be made within 14 days without deductions.
- Liability
TRACKSPEED is only liable for the careful selection of the provider and the proper facilitation of the service, not for the service delivery by the provider.
Disclaimer
- Participant’s Risk
Participation in the event is entirely at the participant’s own risk. The participant bears sole civil and criminal liability for any damage caused, including to the vehicle used. By signing this declaration, the participant waives all claims against TRACKSPEED, its representatives, agents, the race track operator, and their assistants for personal injury, property damage, and financial loss, except in cases of intent or gross negligence.
- Third-Party Claims
If third parties make claims related to the participant’s involvement in the event against TRACKSPEED, its representatives, agents, the race track operator, or their assistants, the participant agrees to indemnify and hold them harmless.
- Compliance
The participant acknowledges having read and agrees to comply with TRACKSPEED’s participation conditions and all rules and regulations of the race track operator.
- Agreement Validity
There are no oral agreements. Any additional agreements must be documented in writing to be valid.
